What is EAR?
The Export Administration Regulations (EAR) are a set of regulations enforced by the United States Department of Commerce that govern the export and re-export of most commercial items, including some dual-use items that have both commercial and military or proliferation applications. These regulations are not limited to traditional defense contractors; they apply broadly to all industries, impacting a wide range of products, technology, and software.
EAR’s scope includes items that are designed for commercial purposes but can also be used in military applications, such as computers, telecommunications, and navigation equipment. The EAR uses the Commerce Control List (CCL) to categorize items based on their sensitivity and the nature of their end-use and end-user.
Compliance Requirements: Key Aspects of Being EAR Compliant
Classification: Determine whether your products, software, or technology are subject to EAR by classifying them under the correct Export Control Classification Number (ECCN) on the CCL or identifying if they qualify as “EAR99” (less sensitive items subject to minimal control).
Licensing: Obtain the appropriate export license if your items are on the CCL and require a license based on their destination, end-user, or end-use. Some items may be eligible for license exceptions.
Screening: Screen all parties involved in a transaction against the U.S. government’s list of denied or restricted parties to ensure compliance with EAR.
Record-Keeping: Maintain accurate export records for at least five years, including information about the item, recipient, destination, and end-use.
Compliance Program: Develop and implement an effective compliance program, including training for employees, internal control plans, and regular audits to ensure ongoing adherence to EAR.
